Introduction

Since 1973, Europa Art & Co. has been associated with stylish shoes and accessories (“the products”), and statements of luxury, craftsmanship and quality. Now, users whom are registered with this website (“the Purchasers”) can shop online and have these signature brands delivered right to their doorstep. Once a purchaser has registered with online shopping, he/she is deemed to have read, understood and accepted these terms and conditions.

Purchasing of the products

Registering with the Europa Art & Co. website enables you to place electronic orders for products displayed on our website, provided that they are not sold out or out of stock. A purchase agreement between you and Europa Art & Co. will come into effect once the chosen products are selected and placed in your “shopping basket” and payment for those products has been made.

Product Availability & Order Fulfilment

While we make every effort to ensure that all products listed on our website are available for purchase, product availability is not guaranteed at the time of order. In rare instances, due to technical errors or system delays, an item may appear available online but is in fact out of stock. We will notify you promptly if your order cannot be fulfilled due to unavailability. In such cases, we reserve the right to cancel the order and will issue a full refund to the following payment methods:

  • Credit or Debit Card payments: Refunds will be credited to your Europa Art & Co. Wallet, log in to your automatically generated account to view your wallet balance. You may elect to withdraw the amount in your wallet at any time, your funds will then be transferred to your selected payment method within 14 business days.
  • Buy Now Pay Later (BNPL) payments, including Payflex, Happy Pay, and PayJustNow – will be refunded through the respective BNPL platform.

Lay-byes (in-store purchases only)

  1. Goods may be purchased on lay-by subject to the following conditions:
    1.1   
    You pay as a deposit 20% of the total purchase price of the goods which are purchased on lay-by;
    1.2   The remainder of the purchase price must be paid in monthly instalments and must be paid in full within three (3) months of payment of the deposit;
    1.3   Only once the purchase price has been paid in full will you become the owner of the goods.
    1.4   Should you terminate the lay-by agreement before paying the total purchase price you will not be entitled to receive the goods and you will be liable for the a cancellation fee as described in paragraph 1.6;
    1.5   Should you fail to pay the total purchase price within sixty (60) business days after the period described in paragraph 1.2 you will not be entitled to receive the goods and you will be liable for the cancellation fee as described in paragraph 1.6;
    1.6   The cancellation fee payable in terms of paragraphs 1.4 and 1.5 is the amount equal to one (1) percent of the total purchase price of the goods purchased on lay-by.
    1.7   Should paragraph 1.4 or 1.5 apply, we will refund in the form of a gift card/credit note all payments made by you towards the goods and will deduct the cancellation fee from such refund.
    1.8   Lay-by purchases that are settled and finalised, will not be exchanged, returned or credited.
  1. Goods which are on sale may be purchased on lay-by subject to the same conditions as above except that the deposit referred to in paragraph 1.1 shall be 50% of the total purchase price of the goods on sale and the repayment period referred to in paragraph 1.2 shall be thirty (30) days in respect of the goods on sale.
  2. Once a lay-by agreement has been initiated, the price of the item is fixed at the time the lay-by was opened. If the item goes on promotion or is later offered at a discounted price, the lay-by cannot be cancelled or adjusted for the customer to repurchase the same item at the promotional price.
  3. Whilst every care is taken to offer the highest quality, the purchase of goods made from natural materials (i.e. wood, cane, corks) or with beadwork, diamantes or trims are purchased at your own risk and the purchase of such goods cannot, in the event of damage, be returned. Europa Art Group reserves the right to assess the damage of such goods and at its discretion shall elect to repair and/or issue a credit note and/or replace such goods, if after such assessment it is evident that the damage is as a result of a manufacturing fault of Europa Art Group, and not due to the negligence of the customer.
  4. Under the Consumer Protection Act, 2008, consumers are entitled to fair conduct.

Online Deliveries

Europa Art & Co. products are delivered within South Africa from Monday to Friday during office hours and can be delivered to either a residential or employment address. Deliveries to countries outside South Africa can be arranged, please contact orders@europagroup.co.za for further assistance. These deliveries can only be delivered to a physical address and the customer will be liable for all delivery, tax and duty costs. This amount is due before delivery can take place.

Europa Art & Co is not liable for any import duties and vat that may be charged by your local customs office outside of South Africa.

Delivery time

Europa Art & Co. will have your products delivered within 24hrs – 5 working days in main city centres, as well as for the store collection option and within 10 – 15 working days for all other regions, from date of dispatch. The main city centres include Bloemfontein, Cape Town, Durban, Johannesburg, Pretoria and East London. We do not guarantee that the products will be delivered within the abovementioned timeframes and will not be liable for any loss and/or liabilities and/or costs and/or damages and/ or expenses arising as a result of the late delivery.

Unavailable at the time of delivery

Should you be unavailable to accept the delivery, the courier company will call you to arrange another possible time for delivery. Should the courier not be able to deliver for a second time due to your unavailability, the goods will be returned to us and you will liable for an additional R100 fee (incl. VAT) for each product that was to be delivered.

Customer Privacy policy

Europa Art & Co. shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.lawsofsouthafrica.up.ac.za/index.php/current-legislation .

Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Europa Art & Co. bank account, the details of which will be provided on request.

Card acquiring and security

Card transactions will be acquired for Europa Art & Co. via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer details separate from card details

Customer details will be stored by Europa Art & Co. separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Returns and Refunds in-store (in the form of credit notes/gift cards)

  1. We will gladly exchange or refund any item in the form of a gift card or credit note, subject to the following conditions:
    • You are in possession of a valid proof of purchase, till slip, or gift receipt.
    • The item is returned within 14 business days from the date of purchase.
    • The item is unused, in its original packaging and condition, with the price tag attached.
    • In the case of defective goods, the item is returned within six (6) months from the date of purchase.
  2. Gift cards are not redeemable for cash.
  3. Items on sale / promotional items (including two pair promotion items) may not be exchanged.

Faulty goods purchased in-store

  1. The customer must inform the relevant store upon discovering the defect and must return the goods within six months of date of purchase.
  2. Upon return, the customer must provide the store with:
    • Valid proof of purchase, till receipt or gift card;
    • Dated photograph of the defect
  3. The customer can elect to have the goods repaired, replaced or to receive a refund for such goods.
  4. The customer will only be entitled to have the goods replaced, repaired or to receive a refund if the goods were used for their intended purpose and were cared for properly.

Returns and Refunds online

If you wish to return your online purchase, Europa Art & Co. will gladly assist, provided the following conditions are met:

  • A valid proof of purchase, till slip, or gift receipt is presented.
  • You notify us of your intention to return the product within 30 calendar days from the date of delivery.
  • The product is unused, in its original condition and packaging, with all tags attached.

Refunds will be processed according to the following payment methods:

  • Credit or Debit Card payments: Refunds will be credited to your Europa Art & Co. Wallet, log in to your automatically generated account to view your wallet balance. You may elect to withdraw the amount in your wallet at any time, your funds will then be transferred to your selected payment method within 5 business days.
  • Buy Now Pay Later (BNPL) payments, including Payflex, Happy Pay, and PayJustNow – will be refunded through the respective BNPL platform.

Please note that delivery fees are non-refundable. Refunds are typically processed within 14 business days after the returned product has been inspected and approved.

Europa Art & Co. offers one free return per order within 30 calendar days from the date your order was received. Any additional return requests for the same order will incur a return shipping fee.

Faulty Goods Purchased online

Should you purchase a defective product online, you must ensure that you notify Europa Art & Co immediately of the defect. The product must be returned within six months from the date of purchase and a dated photograph of the defect taken at the date of delivery will be required. You can then elect to have the product replaced or repaired or the purchase price to be refunded to you.

Cancelling orders online

Customers may cancel an order only if done so within 24 hours of placing such order.

Fraud, Abuse & Irregular Activity
Europa Art & Co reserves the right to cancel any order where it reasonably suspects fraudulent activity, unauthorised use, or abuse of promotions, discount codes, vouchers, or loyalty benefits. This includes, but is not limited to, attempts to exploit system vulnerabilities, multiple or bulk redemptions intended to circumvent promotional limits, or activity that appears inconsistent with normal consumer behaviour.

Where an order is cancelled for these reasons, a refund will be processed in accordance with our online Refund Policy.

Europa Art & Co Wallet

The Europa Art & Co. Wallet (“Wallet”) is a digital wallet facility made available to customers of Europa Art Group (Pty) Ltd (“Europa Art & Co.”, “we”, “our”, or “us”). The Wallet enables you (“you”, “your”, “the user”) to receive refunds for purchases made on www.europaart.co.za, store those funds securely, and use them for future purchases or withdrawals.

By activating or using your Wallet, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

Account Registration and Access

To access and use the Wallet, you must have or create a registered customer account on our website. You agree to provide accurate and complete information during registration and to keep your account details up to date. The Wallet is linked exclusively to your registered account and cannot be transferred, assigned, or shared with another person.

Refunds to Wallet

Refunds for eligible returns may be credited to your Europa Art & Co. Wallet, in accordance with our Refund and Returns Policy. Funds in your Wallet may be used for purchases on our website or withdrawn to your nominated South African bank account. Refunds to the Wallet are deemed final once processed, and no cash refunds will be issued unless otherwise stated under applicable consumer protection laws.

Wallet Use and Withdrawals

To withdraw funds, you must submit valid and accurate banking details. Europa Art & Co. is not responsible for losses resulting from incorrect or incomplete account details provided by you. Withdrawals will be processed within a reasonable period, subject to verification and standard payment clearance times. Europa Art & Co. reserves the right to request identity verification or supporting documents before processing withdrawals.

User Responsibility for Security Credentials

You are solely responsible for maintaining the confidentiality and security of your account credentials, including login details, passwords, PINs, and any biometric or device authentication data (“Device Credentials”). You must not share your credentials with any person, including family members, Europa Art & Co. staff, or third parties. Any transaction performed after successful login using your credentials will be treated as authorized by you. You will be liable for all transactions and losses arising from unauthorized use unless you have notified us immediately of a suspected breach, loss, or compromise of your credentials.

Device Security

You are responsible for the security of the device used to access your Wallet. You must take reasonable precautions, including:

  • Using up-to-date antivirus and operating systems;
  • Enabling device passcodes or biometric protection;
  • Avoiding the use of “rooted” or “jailbroken” devices;
  • Ensuring data is deleted when disposing of or transferring your device.
  • Europa Art & Co. will not be liable for losses resulting from your failure to secure your device or credentials.
Data Collection and Privacy

By using the Wallet, you consent to the collection, processing, and storage of your personal and transactional data in accordance with the Protection of Personal Information Act (POPIA). We collect and process data for the purposes of account creation, transaction processing, fraud prevention, and compliance with legal obligations. We may share your information with trusted third-party service providers (including payment processors and wallet infrastructure providers) who are bound by confidentiality and data protection obligations. Third-Party Wallet Provider Terms

The Wallet may integrate with third-party payment processors or service providers. You acknowledge that these providers have their own terms and privacy policies, and you agree to comply with them. Europa Art & Co. disclaims liability for security or operational failures arising from such third-party systems, except where required by law.

Security Standards and PCI DSS Compliance

Europa Art & Co. and its service providers adhere to the Payment Card Industry Data Security Standards (PCI DSS) and related best practices for secure handling of payment data. We do not store your full credit card details or CVV/CVC numbers on our systems.

Notification of Breach or Loss

You must immediately notify Europa Art & Co. if:

  • Your device or account credentials have been lost, stolen, or compromised; or
  • You notice or suspect unauthorized transactions or activity on your Wallet.
    Notifications can be made via support@europaart.co.za. Failure to report promptly may result in liability for any resulting loss.
Service Availability and Disclaimer

While we aim to provide continuous access to the Wallet, we do not warrant uninterrupted, secure, or error-free operation. We reserve the right to suspend, modify, or terminate the Wallet service at any time without prior notice, where necessary for maintenance, upgrades, or security reasons. To the maximum extent permitted by law, Europa Art & Co. shall not be liable for any indirect, incidental, or consequential losses arising from use of the Wallet, except where caused by gross negligence or willful misconduct.

Termination and Account Closure

You may request to close your Wallet at any time by contacting customer support. Any remaining funds will be refunded to your nominated bank account after verification. Europa Art & Co. may suspend or terminate your Wallet access if there is evidence of misuse, fraud, or breach of these terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

Changes to Terms and Conditions

Europa Art & Co. may, in its sole discretion, change these Terms and Conditions or any part thereof at any time. If you are a registered purchaser, a notification informing you of the changes will be sent via email to the email address you used when registering. You will be responsible for reading the revised Terms and Conditions and ensuring that you are satisfied with them. Should you not be satisfied with the changes, you are entitled to cancel your registration with Europa Art & Co. .
